Fleeing from the scene of an accident is worse than just avoiding responsibility: It can delay the arrival of emergency services, putting accident victims in danger of more severe injuries and even death. And yet thousands of people do it every year. They get into an accident, either with another vehicle or by hitting a pedestrian, they panic, and they drive away. They might be trying to hide the fact that they were driving under the influence of alcohol, or they may simply be trying to avoid the financial consequences for their actions. California Hit & Run Laws
Under the California Vehicle Code, fleeing the scene of a car accident is a crime. It can be a misdemeanor or a felony, depending on whether someone was injured. After a crash that caused property damage or injury, any involved driver is obligated to do the following:
- Stop at the nearest safe location
- Locate the owner of the other vehicle
- Present their license and vehicle registration, if asked
- Present their contact information, including their current address
- If the owner is not present, they must leave a note with identifying information
- If someone was injured, the driver must call 9-1-1 and must report the accident to the police or the California Highway Patrol within 24 hours
Failing to stop and help after a crash that involved injury or death is a felony.
Hit & Run Accidents Remain a Deadly Problem in California
We would like to think that with the advent of smartphones and more powerful security and traffic cameras, that hit & runs would be a thing of the past. Unfortunately, many drivers in California and across the country still flee the scene after an accident, out of fear for their own liability or simple callous disregard for the damage they have caused. According to safety officials, California leads the country in the number of fatal hit-and-run crashes.
In 2016, 2,049 deaths in the U.S. resulted from hit-and-run crashes. Three hundred thirty-seven of those occurred in California. It’s the highest number of hit-and-run fatalities the state has ever seen and represents a 60 percent increase over 2009. It’s also more hit-and-run fatalities than any other state, although, on a per capita basis, California ranked 7th for hit-and-run deaths. There may be positive news on the horizon: In 2017, there were only 20 hit-and-run deaths in the city of San Francisco, the lowest number since they started tracking the statistics.
Fleeing from the scene of a car crash is simply unforgivable.
