Pedestrian Rights in California

We have all heard the old adage, “pedestrians have the right of way.” But what does that actually mean under California law? What does that rule offer in terms of liability in the event of an accident? It does not mean that the pedestrian is always right, no matter their behavior. It does mean that when a pedestrian is acting lawfully, drivers have a responsibility to drive cautiously, observantly, and let pedestrians pass unhindered.

According to the California Vehicle Code, drivers “shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” So long as a pedestrian is crossing at a marked crosswalk, or crossing legally where there is no marked crosswalk, any approaching driver must slow and yield to let the pedestrian cross. If they fail to do so, and the pedestrian is injured, it is the fault of the driver, and they are legally responsible for any resulting injury.

There are limits. Pedestrians must not “suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard.” Basically, as long as a pedestrian does not run across the street when a car is already about to reach the intersection, the pedestrian still has the right of way. Pedestrians should also take care when crossing without a legal crosswalk–pedestrians are supposed to yield to drivers in that case. However, even if a pedestrian crosses the street without a crosswalk, a negligent driver might still be liable if it is their negligence that caused the crash. California has a “comparative negligence” rule for personal injury, meaning that a person who is partially responsible for their own injuries (e.g., a pedestrian who crosses without a crosswalk) can still recover as long as they can show that the other party is also legally at fault.
